Welcome to xxcited.ai (“Xcited AI”, “we”, “us”, or “our”).

These Terms of Service (“Terms”) govern your access to and use of the xxcited.ai website, platform, applications, and services (collectively, the “Services”). By accessing or using our Services, you agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not access or use the Services.

1. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Services.

By using xxcited.ai you represent and warrant that:

• you are at least 18 years old
• you have the legal capacity to enter into a binding contract
• all information you provide is accurate and truthful

We reserve the right to request verification of age where required.

2. Description of the Services

xxcited.ai provides an AI-powered platform that enables users to interact with virtual AI-generated characters (“AI Companions”) through:

• text conversations
• image generation
• multimedia interactions
• other AI-generated content features

All AI Companions and generated content are fictional and digitally generated.

The Services are provided for entertainment purposes only.

AI-generated responses may sometimes be inaccurate, incomplete, or inappropriate. Users are responsible for evaluating any content generated by the platform.

3. User Accounts

To access certain features of the Services, you may need to create an account.

You agree to:

• provide accurate registration information
• maintain the confidentiality of your login credentials
• be responsible for all activities under your account

You must not:

• share your account with others
• create accounts using automated methods
• impersonate other individuals

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

When using the Services, you may provide prompts, messages, or other input (“Input”) and receive AI-generated responses (“Output”).

Together these are referred to as “Content.”

You retain ownership of your Input. However, by using the Services you grant xxcited.ai a non-exclusive, worldwide, royalty-free license to use, process, store, and analyze Content for purposes including:

• operating the Services
• improving AI models
• security and moderation
• research and analytics

You are responsible for ensuring that your Content:

• does not violate any laws
• does not infringe intellectual property rights
• does not violate the rights of others

5. Prohibited Conduct

You may not use the Services to generate or distribute content that includes:

• illegal activities
• harassment or hate speech
• violence or threats of violence
• exploitation or abuse of minors
• impersonation of real individuals
• non-consensual intimate imagery
• attempts to bypass platform safeguards

Attempts to generate content involving minors or resembling minors are strictly prohibited.

Violation of these rules may result in account suspension or termination.

6. Payments and Credits

Some features of the Services require Credits, a prepaid balance you top up in one-time purchases. There are no subscriptions, memberships or recurring charges: nothing renews and nothing is charged automatically.

By purchasing Credits you agree that:

• each purchase is a single, one-time charge for the Credit pack you select, at the price shown at checkout
• Credits are deposited to your account once the payment is confirmed and do not expire
• payments are processed by third-party payment providers; xxcited.ai does not collect or store your card or wallet details
• Credits have no cash value, cannot be transferred or exchanged, and are consumed when you use paid features

Refunds. Credits are non-refundable once used. If a payment was made in error and the Credits are unused, contact support within 24 hours and we will handle the refund manually. Credits deducted for a generation that fails are returned to your balance automatically.

7. AI Content Disclaimer

The Services rely on artificial intelligence systems.

You acknowledge that:

• AI-generated content may be inaccurate
• AI characters do not represent real individuals
• conversations are fictional simulations

xxcited.ai does not guarantee the accuracy, reliability, or appropriateness of generated content.

8. Moderation and Enforcement

To maintain a safe environment, we may:

• monitor usage patterns
• review flagged content
• remove content that violates our policies
• suspend or terminate accounts

We may also cooperate with law enforcement authorities when required by law.

9. Intellectual Property

All platform content, including:

• software
• platform design
• AI characters
• trademarks and logos

are the property of xxcited.ai or its licensors.

You may not copy, reproduce, distribute, or exploit platform materials without written permission.

10. Limitation of Liability

The Services are provided “as is” and “as available.”

To the fullest extent permitted by law, xxcited.ai disclaims all warranties, including:

• merchantability
• fitness for a particular purpose
• non-infringement

xxcited.ai shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.

11. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the “Last Updated” date and may notify users through the platform.

Continued use of the Services constitutes acceptance of the updated Terms.
